Terms of use

Accounts

• You must give accurate details and keep your password safe. You are responsible for what is done with your account.
• Tell us at once at info@bimastack.com if you think someone else has used it.

Organisations

• Anyone registering an agency, brokerage or insurer confirms they are authorised to act for it.
• We review every organisation before it goes live and may decline one, for example when its details can’t be verified.
• Each organisation is responsible for holding the licences its business needs (including from the Insurance Regulatory Authority), for the products it sells, the advice it gives, and its dealings with its own clients.
• Each organisation is the controller of its clients’ personal data, and must handle it lawfully.

Subscriptions and the free trial

• Every plan starts with a 7-day free trial from the day the organisation is approved.
• After the trial the organisation moves to a paid monthly plan to keep using the platform. There is no permanent free plan.
• BimaStack charges a subscription only. We never take a commission or a percentage of premiums.
• Features marked “coming soon” are not part of a plan until they are released.
• Enterprise terms are agreed in writing and take precedence over these terms where they differ.

Acceptable use

You must not:

• break the law, or help anyone else to, including insurance and data protection law;
• try to reach another organisation’s data, or test the platform’s security without our written permission;
• overload, disrupt or reverse-engineer the platform;
• post comments that break our community guidelines.

Your content

Your organisation’s data stays yours. You give us the right to host and process it only to provide the platform to you. You can export it, and when you leave we delete it after any period the law requires us to keep it.

Availability and liability

We work to keep BimaStack available and accurate, but provide it as it is. Prices come from the rates each insurer configures and approves; the insurer is responsible for them. To the extent the law allows, our liability is limited to the fees paid in the 12 months before a claim.

Ending

You may close your account at any time. We may suspend an account or organisation that breaks these terms, and will tell you why.

Law

These terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction.
